How Do I Apply to have my Alternative Treatment Technology Reviewed for Approval in West Virginia?
West Virginia adopted the guidelines established by the STAATT in their document, Technical Assistance Manual: State Regulatory Oversight of Medical Waste Treatment Technologies.
WV Application for Alternative Treatment Technology Evaluation and Approval
The State and Territorial Association on Alternate Treatment Technologies (STAATT) was developed to create technical and administrative procedures for the review and approval of all treatment systems, particularly technologies other than incineration and autoclaving.

Note: Alternative Treatment Technologies employing disinfection must have their disinfectant registered with the U.S. Environmental Protection Agency under the Federal Insecticide, Fungicide, and Rodenticide Act.
Note: The review and assessment process will not commence until all information required is submitted and received.
Persons interested in applying for approval of a new Alternative Treatment Technology in West Virginia must submit a completed Application for Evaluation and Approval (Appendix B) including:
- A listing of the classes and amounts of infectious medical waste the method could be employed to treat;
- A copy of the detailed plans for the device used in the method;
- A written summary of the proper operation of the method and device;
- A copy of the operation and maintenance manual for the process or device;
- Copies of approval and denial letters from other states where the process has been evaluated;
- A copy of an evaluation report provided by a testing laboratory independent of the applicant using a testing protocol approved by the Secretary confirming the efficacy of the treatment process and that the process does not produce a hazardous waste, discharge or air emission;
- A non-refundable alternative technology evaluation fee of $500.00.

*All solidification products are subject to a hold time prior to disposal. Hold times allow the product to effectively disinfect the contents of a suction canister, as well as to set up. Healthcare facilities are required to ensure the proper disposal of solidified liquids.
At this time, only these five(5) products can be used to solidify and disinfect liquid infectious medical waste intended to be land filled. If a disinfectant solidifier is used the the waste (usually from a suction canister) may go into the regular waste , BUT these items MUST have a label identifying the material as treated infectious medical waste and also include information that identifies the generator of the original infectious medical waste. And include the statement " I hereby certify under penalty of LAW that this waste has been rendered non-infectious in accordance with the procedures required by WV Infectious Medical Waste Rule 64 CSR 56. "
Any other solidification products may be used as long as suction canisters are disposed in the infectious medical waste.
It is a violation of the West Virginia Infectious Medical Waste Rule if you do not follow the manufacturer's instructions for use for any of these products.
